Abstract

This paper aims a historical perspective on the understanding of collegiality in the Brazilian Courts and, mainly, to the Brazilian Supreme Court. Through documentary and bibliographical research, it was possible to reconstitute the discourse created by historians about the origin and functionality of collegiality in Brazilian Courts. The result was the identification of multiple factors of influence, such as an Iberian heritage and the respect and observance of Brazilian customs and habits, and not Italian law as Brazilian jurists claim.
